This page contains the "small print" that isn't particularly interesting to read, but is necessary to prevent any surprises for you or us. Thanks for taking the time to read this page!
Website Defined
The specifications of the "Website" will be as follows:
- An introductory page to the site called the Home page, which will serve as a basic template for additional pages, and will include a top-of-page graphic (custom graphic incorporating name and/or logo graphic), a navigational menu, up to 250 words of text supplied by Client, and up to three (3) photographs OR graphics supplied by Client at an original size no greater than 8"X10".
- Additional web pages. A web page consists of up to three photographs or graphics supplied by Client at an original size no greater than 8"X10" and no more than 700 words of text.
Website Updates & Maintenance
We provide updates for your existing website at $30/hour billed in 15 minute increments.
Email Accounts
A limited number of email accounts is included with your hosting contract. Each account is set at a 5 MB limit, unless you request larger mail boxes. We require that you download and remove all email from the server on a regular basis regardless of the size limit of your account. Because your account is on a shared server, we do not permit relaying of outgoing email through the server. All outbound messages must be routed through your ISP. If this all sounds like Greek to you, never fear, we'll be happy to explain in detail and step you through the process of setting up your account.

Payments
We require payment of 50% of a project contract before any work begins, and the final 50% upon your final approval of your website design or redesign.
Website updates will be billed monthly by email unless another method is requested.
All payments must be paid in U.S. funds on a U.S. bank.
We hope that the following measures will never be necessary, but in the event that it is we want you to know up front what steps will be taken. Delinquent bills will be assessed a $50 charge if payment is not received within 10 days of the due date. If an account remains delinquent 30 days after its due date, an additional 5% penalty will be added for each month of delinquency. If you delay payment more than 30 days after your bill is due, we reserve the right to remove your website from the internet until full payment is made. In case collection proves necessary, you agree to pay all fees incurred by that process.
Project Delivery
Once you provide full and final payment, we will transfer your completed website to its hosting service, whether provided by us or by a host of your choosing. Hosting of your website with us requires a separate annual contract apart from the design of your site. We will provide a zip file of all final website files upon your request.
Refunds
We do not give refunds for website design and updates, nor for domain name registration or renewal. If you are not completely satisfied with our hosting services within the first 30 days of hosting contract, we will give a full refund of the contract amount excluding any setup fees.
Search Engine Submission
We will submit your website to search engines after you have given final approval of your website and made the full and final payment.
Subcontracting
We reserve the right to assign subcontractors to web design projects to insure that the terms of our agreement with you are met. We will only hire subcontractors who meet our strict standards for quality and performance.
Copyright
Copyright to the finished assembled work of web pages is owned by Fern Web Design. Upon final payment of contract, we give you the rights to use as a website the combined design, graphics, and text contained in the finished assembled website. Rights to photos, graphics, source code, work-up files, and computer programs remain the property of their respective owners and are not specifically transferred to you for exclusive rights. We will provide use of custom programs/scripts as long as your website is hosted with us. We retain the right to display graphics and other website elements as examples of our work. We also retain the right to reuse the design template for other websites, changing enough elements so that your website retains its own unique appearance from any other website we design.
You agree not to provide any materials or information to us for use on your website for which you do not hold the copyright, trademark, or legal rights (or have not obtained permission to use), and you agree to hold us harmless for any violations thereof which result from materials or information which you provide.
You will maintain responsibility for all factual information contained within your website and agree to hold us harmless for any inaccuracies or misinformation.
Termination
Either party may terminate the contract in writing at any time, with costs paid by client for any work already completed.
